Relevance (Amendment) Bill 2005

New Provision
311.4 RELEVANCE RULE Any post (other than a parliamentary question) in the assembly must be relevant to a bill or item before the assembly. Parliamentary questions are not debatable. Previous votes of the assembly in the current legislative term are not debatable except in terms of a motion for their repeal or consideration of a presidential veto.

311.5 ALLEGATIONS Allegations of incapacity, negligence, misconduct or improper motives are not debatable except in terms of a substantive motion allowing a separate and distinct vote on each allegation.

and that the Clearer Motions Rule be renumbered 311.6

Executive Order: Comprehensive Commonwealth Website Order

1. The Commonwealth website is located at the domain www.thevcc.org and housed on the respective hosting service, which are purchased from Who-Ahh! Inc. Web Solutions by the Friends of Cyberia.

1.1 The Commonwealth retains copyright to all content.

1.2 The Friends of Cyberia is an organization of donors that is independent of the Commonwealth. This section is for explanatory purposes.

2. Each citizen may claim one forwarding e-mail address in the following format: firstname.lastname@thevcc.org where "firstname" and "lastname" are those by which the citizen chooses to be known in the Commonwealth.

2.1 Forfeit of citizenship must result in forfeit of the e-mail address.

2.2 Citizens are encouraged to link the e-mail address to an e-mail account used exclusively for Commonwealth participation.

2.3 Citizens are strongly encouraged to sign the e-mail address up for use with MSN Messenger.

3. Section 4 of the Cabinet Operations Executive Order is amended as follows: "4. The Minister of State is responsible for the upkeep of the Constitution, laws and register as detailed in chapter 210.101 of the Federal Code. He or she may host these at lawsvcc.4mg.com or a comparable provider. The Minister must undertake to block e-mail addresses from gathering by spambots."

4. The following pages must be located and housed as described in section 1:
4.1 an informational page for the National Assembly,
4.2 an informational page for the Cabinet,
4.3 an informational page for the judiciary,
4.4 all Cabinet websites,
4.5 the website of the Cyberian Defense Force,
4.6 other executive branch websites as directed by the President,
4.7 other websites as elected by the various independent Commissions,
4.8 other websites as elected by the various provincial and district governments,
4.9 the forum of the Commonwealth as of a near date the President will set.

5. The forum at EZboard.com must be retained for archival and publicity purposes.

6. Use of the term "Commonwealth website" in this order refers to those pages located and housed as described in section 1 for purposes of this order only. It does not modify the definition of a "Commonwealth website" in 270.3 of the Federal Code.

Fairer CBC Bill 2005

New Section
557.6 Anyone may (subject to this Chapter) contribute news andopinion posts.

557.61 News posts must be written in appropriate language with a reasonable attempt at objectivity and one or more hyperlinks to the reported event. The author of a news post must test the accuracy of information from all sources, give subjects of news stories an opportunity to respond to allegations of wrongdoing and identify sources whenever feasible.

557.62 Opinion posts must be marked as such and carry a signature by which the contributor can be easily identified. Opinion posts may not be edited unless they are defamatory or otherwise contrary to law.

557.63 Comments to both news and opinion posts may not be deleted or edited, except where the posting is contrary to Section 557.7.

Old Section
557.6 The Commission may not censor the contributions or comments of any Cyberian citizen. All Cyberians and other persons may submit news and opinion pieces. The only requirements are appropriate language and, in the case of news, (1) a reasonable attempt at objectivity and (2) one or more hyperlinks to the event under discussion.

(2) Section 557.8 is enacted as follows:

Ruling on Complaints Regarding the October 2005 Election Process

There were four seperate issues raised regarding the election and ballot processes:

1) That Peter Hickey was not listed as a Presidential Candidate.

Response: Mr. Hickey, not having voted in the prior election was not elligible for the Presidency. Therefore the election of President Santucci stands.

2) The order of listing for Peter Hickey and Peter Krembs was transposed on the NA and the Raspur Congress.

Response: While the Electoral Commission apologizes for this error, this issue may be resolved by Mr. Hickey resigning from the NA and PFP seat being filled by Mr. Krembs. There is no need to delay the meeting of the National Assembly.

3) Michael Fors was listed as 3rd instead of 2nd preference on SDP list.

Response: While a regrettable error, it did not affect the final outcome, the election of the NA and RASPUR candidates stands.

4) Some Citizens had difficulty getting the links for the text of the Constitutional Amendments to work in their browsers.

Response: While this was unfortunate, this does not constitute a technical error. While I regret the difficulty some citizens experienced in viewing the texts of Amendments, it doesn't constitute an error on the part of this Deparment. I also remain unconvinced that a nullification would get a different outcome. On the Amendment receiving the most votes, 10 citizens voted compared to 11 that voted in the Presidential election, which is a high number. It appears that either through the link sent out or through the CBC, most people who voted were able to access the Amendments to vote on them. The results of the Amendment election stands.

The following are the final election results.

Total registered voters: 14
Voter Turnout: 11
Turnout rate:78%

For President of Cyberia:

Jack Santucci 54.5%
David Catchpole (I) 18.2%
James Conway (I) 18.2%
Peter Krembs (PFP) 9.1%

It is the declaration of the Electoral Commissioner that Jack Santucci is re-elected President in the first round.

The following are the elected members of the National Assembly by the round they were elected in:

On the Rights 1st Amendment, 6 people voted in favor and four voted against. Those voting in favor were equal to 42% of electors, short of the 60% required by law and the Amendment is lost.

On the Electoral Reform Amendment, 8 people voted in favor and 1 voted against. Those voting in favor were equal to 56% of electors, short of the 60% required by law and the Amendment is lost.

On the Working Assembly Amendment, 7 people voted in favor and 2 voted against. Those voting in favor were equal to 50% of electors, short of the 60% required by law and the Amendment is lost.

On the Deliberative Democracy Amendment, 5 people voted in favor and 4 voted against. Those voting in favor were equal to 36% of electors, short of the 60% required by law and the Amendment is lost.

Electoral Reform Amendment (No 2) 2005

New Provisions
1.8 GENERAL ELECTIONS General elections must be held on the first Saturday in January, April, July and October in every year,
but the month and day may be changed by law. Voting must continue for a period (not less than 48 hours) fixed by law and no longer.

Old Provisions
1.8 GENERAL ELECTIONS General elections must be held on the first Saturday in January, April, July and October in every year,
but the month and day may be changed by law. Voting must continue for 48 hours and no longer.

This allows the National Assembly to extend voting time. It keeps the 48 hour minimum. Extending voting to 4 or 5 days will help overcome the public holiday problem and raise the turnout.

Rights First Amendment (No 4) 2005

that (1) Article 3 be renumbered Article 1;

(2) Articles 1 and 2 be renumbered Articles 2 and 3 respectively;

(3) the Charter of Rights be amended by inserting present Section 1.1 as the first section and renumbering all later sections as appropriate;

Having been submitted on the 31st and receiving no objections, I believe this motion has reached the requisite time in which to meet unanimous consent. I therefore declare it passed by the National Assembly.
