Ruling on Complaints Regarding the October 2005 Election Process
There were four seperate issues raised regarding the election and ballot processes:
1) That Peter Hickey was not listed as a Presidential Candidate.
Response: Mr. Hickey, not having voted in the prior election was not elligible for the Presidency. Therefore the election of President Santucci stands.
2) The order of listing for Peter Hickey and Peter Krembs was transposed on the NA and the Raspur Congress.
Response: While the Electoral Commission apologizes for this error, this issue may be resolved by Mr. Hickey resigning from the NA and PFP seat being filled by Mr. Krembs. There is no need to delay the meeting of the National Assembly.
3) Michael Fors was listed as 3rd instead of 2nd preference on SDP list.
Response: While a regrettable error, it did not affect the final outcome, the election of the NA and RASPUR candidates stands.
4) Some Citizens had difficulty getting the links for the text of the Constitutional Amendments to work in their browsers.
Response: While this was unfortunate, this does not constitute a technical error. While I regret the difficulty some citizens experienced in viewing the texts of Amendments, it doesn't constitute an error on the part of this Deparment. I also remain unconvinced that a nullification would get a different outcome. On the Amendment receiving the most votes, 10 citizens voted compared to 11 that voted in the Presidential election, which is a high number. It appears that either through the link sent out or through the CBC, most people who voted were able to access the Amendments to vote on them. The results of the Amendment election stands.
